1 – INFORMATION COLLECTION AND USE
Kinova Academy | Kinova Académie is the sole controller of the information collected on this Platform. Personal information, such as your user’s name, first and last name, postal and e-mail address, gender, date of birth and age, company, company function, phone number, funding source of your project, payment information and other details may required to access or use the Platform.
Kinova Academy | Kinova Académie collects, uses or discloses user and client personal information collected through the Platform to provide users and clients with information about our products and services, or promotional offers from our partners, process and assess client’s and user’s requests and inquiries, to contact users or customers, as appropriate, to facilitate navigation of the Platform; to improve our services to clients, or for any other purpose specified at the time of collection. We also may use personal information for other additional purposes but only if you have given consent or such use is required or permitted by applicable law. We will identify these additional purposes at the time of collection.
2 – REGISTRATION
In general, when you visit our Platform and access information, you remain anonymous. Some areas of our Platform, especially when creating an account, may require registration to access and we will ask you to provide us with some information, although typically all that is required is your e-mail address and some basic information about you, such as name, company’s name and job function.
3 – PAYMENT INFORMATION
When you make a financial transaction on the Platform, you may be asked to provide, in addition to your name and email address, your billing address and phone number in order to confirm your order and comply with any applicable law. When payments are made on the Platform without the use of third party payment processors, we may collect and store your payment information. However, when we use the services of third party payment processors, we do not collect or store any of your payment information (such as bank account or credit card information). The collection and use of your payment information is then subject to the privacy policies of those third party payment processors.
4 – LOG FILES
We may use IP addresses to analyze trends, administer the Platform, track users’ movements and gather broad demographic information for aggregate use. IP addresses are not linked to personal information. Unless otherwise indicated in this Privacy Policy, this information is not shared with anyone outside of Kinova Academy | Kinova Académie and/or its designated contractors. When shared with contractors, IP addresses are used only for the purpose of analyzing user trends and demographics. No IP addresses will be shared with any third party other than for such research and reporting services for Kinova Academy | Kinova Académie’s internal use.
5 – INFORMATION SHARING AND DISCLOSURE
Kinova Academy | Kinova Académie may partner with third party contractors to help provide other services. These companies are contractually prohibited from retaining, disclosing, storing or using personal information for purposes other than those authorized. We may share aggregated demographic information about our user base with our partners and clients on a confidential basis. This information does not personally identify users.
Kinova Academy | Kinova Académie may share personal information (excluding payment information) with partners intervening on the Platform, in particular with trainers external to Kinova Academy | Kinova Académie, who may keep, store or use users’ personal information. Users will be informed beforehand by Kinova Academy | Kinova Académie and will be able to oppose this sharing of confidential information.
6 – LEGAL DISCLAIMER
We only collect that information necessary for the purposes that are identified in this policy, by lawful means and for legitimate business reasons. We will not use personal information obtained for a particular purpose for anything else without informing you first and obtaining your express consent, when required. We, however, reserve the right to disclose personal information as required by law and when such disclosure is necessary to protect to safeguard our personnel, rights or property, or for safety reasons, and/or to comply with a judicial proceeding, court order or legal process served on us, or to respond to a government or other administrative request. We reserve the right to disclose certain personal information in connection with a sale of all or part of our business or assets, or the business or assets of our affiliates, whether voluntary or as a result of bankruptcy proceedings.
Kinova Academy | Kinova Académie complies with this Privacy Policy and is subject to applicable Canadian private sector data protection laws such as the Personal Information Protection and Electronic Documents Act and the Act respecting the Protection of Personal Information in the Private Sector (Quebec) and substantially similar laws applicable in every single case pertaining to the collection, use and disclosure of personal information in the rest of Canada and in the United States of America. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints or issues regarding the collection, use or transfer of personal data that we cannot resolve directly with the relevant individuals.

This Platform may contain links to other websites. Please be aware that Kinova Academy | Kinova Académie is not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave our Platform and to read the privacy statements of each and every website that collects personal information. This privacy policy applies solely to information collected by this Platform.
8 – SECURITY
Kinova Academy | Kinova Académie has implemented generally accepted privacy standards for technology security to protect information from loss, misuse, unauthorized access, copy or alteration. It has also implemented technical and organizational safeguards in accordance with which only employees who need the information to perform a specific job are granted access to personally identifiable information. However, no method of transmission over the Internet or method of electronic storage is 100% reliable. As a result, we cannot guarantee the absolute security of your personal information and we encourage our customers to follow generally accepted privacy standards.
9 – INQUIRIES BY E-MAIL OR CONTACT FORM
We will only use personal information provided to us via inquiries by e-mail or through the contact form on our Platform to respond to your inquiry or to manage our business relationship with you or your employer. We may also collect your name, title, company, address, and contact information including phone number and e-mail address and any information which you send to us or post on our Platform, such as when you make an inquiry through our Platform. 10 – JOB APPLICATION
When you apply to work with us through our Platform, we will use your personal information to process your application and monitor recruitment statistics. We may transfer your personal data outside of your home country and to other companies in our group if such is required by the position for which you hand in your application.
We also use third parties to assist us in our recruitment process, which may have access to your personal information, but such third parties are contractually bound to use such data only on instruction of Kinova Academy | Kinova Académie and only for the purpose to process your application.
11 – CHILDREN AND OUR SERVICES
We do not cater to children. In this regard, you must be of legal age in your country, province or state of residence to use the services offered by Kinova Academy | Kinova Académie and the Platform.
You must also be of legal age to consent to the processing of your personal data in your country, province or state of residence. We do not knowingly collect personal information from persons under the legal age. 12 – NOTIFICATION OF CHANGES
If we decide to change our Privacy Policy, we will make commercially reasonable efforts to advertise those changes on this page so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Your continued use of the Platform following the implementation of such changes constitutes acceptance of this Privacy Policy as amended.
